CHARTERS TERMS AND CONDITIONS |

DEFINITIONS:
"The vessel" is MV Phantom
"The client" means the charterer of MV Phantom or their
appointed agent. |

CHARTER
PAYMENT |
| |
A 25 % deposit
within 5 days of booking is required for charter
confirmation. Balance of charter fee is required within 30
days of deposit received. If charter is booked within a 30
day period full payment is required at time of booking.
Payment can be made by Direct Deposit, cash, cheque or
credit card – Visa or MasterCard. Credit card payments
– Surcharge of 1.5 % on credit cards |

CANCELLATION
POLICY |
| |
Monies held by Phantom Charters are subject to refund /
cancellation conditions as followed –
-
Cancellation 30 days or more prior to
departure date, a full refund will be made.

Cancellation between 30 days and 14 days
prior to departure date a 75% refund will be
made based on the whole charter fee.

Cancellation between 14 days and 7 days
prior to departure date a 50% refund will be
made based on the whole charter fee.

Cancellation less then 7 days prior to
departure no refund will be made based on
the whole charter fee.

RELOCATION |
| |
For MV Phantom to relocate to another port for guests to
embark or disembark outside of Port Douglas. A vessel relocation fee of
$12 per klm applies.
Relocation fee will be advised prior to booking confirmation following
Captain consultation. |

INSURANCE |
| |
Travel insurance is highly recommended for insuring against
the deposit or whole charter fee in the event of having to cancel your
charter booking or cancellation of the charter due to force majuere,
lost baggage, personal items and medical expenses. |

CRUISING AREA |
| |
The client shall restrict the cruising of MV Phantom to
within the cruising area and to within regions MV Phantom is permitted
to cruise. The client also agrees to restrict time underway to an
average of 3 hours per day, unless the Captain, at his sole discretion,
agrees to exceed this time. |

AUTHORITY OF
CAPTAIN |
| |
The Captain of MV Phantom shall be suitably qualified and
carry all necessary licenses for a vessel of MV Phantoms specifications.
The client recognises the authority of the Captain in all matters,
regarding safety ( including service of alcohol ) navigation and speed
of MV Phantom and associated equipment ( tender and water sports
equipment ). Further, the client recognises the authority of the Captain
in reference to anchorages and itinerary alterations due to weather or
Force Majeure.
Should the client fail to recognise the authority of the Captain, the
owner of MV Phantom holds the right to cancel the charter with all
outstanding monies to be settled by the client. |

DELAY OR
FAILURE TO DELIVER |

In the event that the charter is unable to commence due to
mechanical failure or circumstances within the control of the owner, all
monies paid to the owner by the client will be refunded or at the
discretion of the owner who may provide an alternative vessel of similar
size and quality in order to perform the charter.
In the event that the charter has commenced and is unable to be
completed due to mechanical failure or circumstances within the control
of the owner, the charter fee paid to the owner will be refunded on a
pro rata basis. |
